General Terms and Conditions of Hotel Modena ***

I. TERMS AND ORDER EXECUTION

I.1. The customer is a legal or natural person who places an order.
I.2. The operator is the company ProZeta s.r.o., Padlých hrdinov 24, 821 06 Bratislava.
I.3. An order is the booking of accommodation and other related services (e.g., meals, parking, etc.) at Hotel Modena, located at Vlčie hrdlo 1/A, Bratislava.
I.4. The order can be placed by the customer in person, by phone, by e-mail.
I.5. Upon confirmation of the order, the operator will immediately reserves the order in the hotel reservation system.
I.6. After the order is placed and confirmed by the operator according to section I.3., a contractual relationship is established between the customer and the operator, which is governed by these Terms and Conditions.

II. PRICE PAYMENT CONDITIONS

II.1. The operator has posted the services pricelist on its website and at the hotel reception.
II.2. By placing the order, the customer gives consent to the payment of the published prices for the services ordered.
II.3. The customer is obliged to make full payment for the order in advance, prior to the provision of services as per the order, either by transfer to the operator's account, by credit card, or by cash payment at the hotel reception. In case of cancellation of the order, the operator is obliged to set off the booking fee with the cancellation payment and to return part of the payment for the order, reduced by the cancellation fee, to the customer via bank transfer, credit card, or cash at the hotel reception.
II.4. The operator has the right to require the customer to pay a reservation fee to secure the services according to the customer’s order. This right is exercised by the operator by sending a reservation voucher to the customer (by e-mail), in which the operator will specify the total price of the order, the amount of the required reservation fee, its due date, and the cancellation conditions, which may differ from the cancellation conditions specified in Article III of these Terms and Conditions. The reservation fee is not subject to taxable transactions under the VAT Act and will be deducted from the final price of the order once paid.

III. CANCELLATION POLICY AND FEES

III.1. The customer has the right to cancel the order by e-mail.

III.2. The cancellation of the order does not, according to these business terms, mean an unrecognized non-service rendition from the operator by the ordering customer.

III.3. By making an order, the customer agrees to the cancellation conditions of the operator.

III.4. Upon cancellation of the order, the operator is entitled to a cancellation fee:

  • in the period 1.1.-29.12. cancellation of the order more than 2 days prior to arrival is free of charge,
  • in the period 1.1.-29.12. cancellation less than 2 days before the day of arrival or on the day of arrival incurs a cancellation fee of 100% of the price of the ordered service, excluding local tax.
  • in the period 29.12.-1.1. cancellation of the order more than 30 days prior to arrival is free of charge,
  • in the period 29.12.-1.1. cancellation less than 30 days before the day of arrival or on the day of arrival incurs a cancellation fee of 100% of the price of the ordered service, excluding local tax.

 

III.5. After cancellation of the order, the customer is obliged to pay the cancellation fee, the amount of which is determined in accordance with paragraph 4 of this article, to the operator’s account [SK72 0900 0000 0052 2815 3401] within three working days from the day of the cancellation of the order. The operator is entitled to charge a penalty of 0.5% per day on the unpaid amount or part of the payment.

III.6. The cancellation fee in the event of cancellation or partial cancellation of an order is not a taxable transaction under the VAT Act.

IV. ACCOMMODATION OF PARTICIPANTS - GROUP (over 30 persons)

IV.1. Unless otherwise agreed with the hotel, the following terms and conditions apply for booking accommodation for a group of participants:
DEPOSIT and PAYMENT:

  • 30-50% of payment for accommodation by the date of booking confirmation (usually date of option)
  • Reservation in option can be canceled free of charge by both parts during the date of option.
  • The customer is obliged to pay the remaining amount for the ordered services based on the order at the latest upon the arrival of the group at the hotel.

IV.2. Upon cancellation of the order, the operator is entitled to a cancellation fee:

  • Cancellation of reservation until the advance payment is possible without storno charge.
  • Cancellation of reservation 30-8 days prior to arrival is 50% of price of the accommodation, excluding local tax (local tax is €3.00 per person per night).
  • Cancellation of reservation 7 days before the arrival is for 100% of accommodational and restaurant services price, excluding local tax (local tax is €3.00 per person per night).
  • Cancellation conditions apply for the accommodation of the group of participants upon cancellation of the reservation or for the non-appointment of the agreed number of rooms.

IV.3. IV.3. Cancellation conditions apply to accommodation of a group of participants in the event of cancellation of the reservation or if the agreed number of rooms is not occupied. IV.3. Any provisions that are not regulated in Art. IV. are appropriately regulated according to Art. I, Art. II and Art. III.

V. EVENTS

V.1. Events include conferences, meetings, training sessions, family events, and business meetings.

V.2. The organizer of the event must notify the operator of the final number of participants no later than 7 working days before the event in order to provide the operator with the necessary preparations for the event.

V.3. Prices and payment - unless otherwise agreed with the hotel, the following conditions apply for event reservations:

  • The customer is obliged to pay 25% of the total price for the ordered services, after the ordering of the services and subsequent approval of the order by the operator based on the advance invoice issued by the operator, no later than 20 days before the event.
  • The customer must pay the remaining amount for services ordered under the order no later than 1 day before the official start of the event unless otherwise agreed with the client in the order.
  • The customer is obliged to pay the remaining amount for the ordered services based on the invoice issued by the operator no later than 7 days from the invoice date.

After the order is cancelled by the customer, the operator is entitled to cancellation fees, see Article III.

VI. REFRESHMENTS

  • All refreshments served in the form of buffet tables that are not consumed during the reserved time (e.g., coffee breaks, lunch, or dinner) must be handed over to the hotel staff within 2 hours of the start of serving, in accordance with hygiene regulations and HACCP - EU standards.
  • For reasons of adherence to hygiene practices and standards, the hotel does not allow the consumption of cooked meals or the bringing of meals into hotel rooms that were exclusively for consumption in the hotel. Unless otherwise agreed, there is a strict ban on bringing all types of meals and drinks (alcoholic or non-alcoholic) into the hotel.

VII. WELLNESS

  • Entry to the wellness center and use of the saunas and whirlpools is not recommended for people with cardiovascular diseases or other conditions that could worsen their health.

  • Entry for children and adolescents is allowed only when accompanied by an adult who is responsible for their safety.
  • Swimming in water above 36°C is not recommended for children under 3 years of age or for people with cardiovascular diseases or other conditions that could worsen their health.
